Question: Hi, Sorry for the long story to get to my question, but it's all relevant.for first time in 40 years, I am a 60 yr old Man was arrested in May '15 for impaired driving (First time I had ever pulled over). My BAC was .03 (from 2 beers at dinner 4 hours earlier). Urine test confirms presence of Adderall and xanax, which I have taken for many years. Also I take a lot of other meds, all prescribed, none narcotic. BC of them mere presence of Xanax and Adderall, the amount of the drug was was not reported. Urine test also showed bac of .02, lower than the BAC. SIGNIFICANT: At the time of the arrest I had Cervical Myelopathy, with Stenosis, with severe cord compression at C4-5-6-7. My symptoms were numbness in fingers, numbness in toes and pain in pads of feet. My gait had been observed as abnormal by MD and PT, balance and coordination also affected. I also have 'natural' Romberg and nystagmus. I informed the officer that bc of my injury, and the lack of feeling in my toes, I would most likely not be able to balance on one foot or walk in a perfect straight line - and that proved true. I still can't do it. Officer also tested me Positive of Romberg and nystagmus, which I was later found to have congenitally. Two months later a neurosurgeon did a laminoplasty on my neck, and observed that my cord compression was even more sever than MRI had revealed.

My position is that every test I failed at completely mimicked the symptoms of my injury. Every one. But, DA is under pressure to prosecute ALL DUI arrests bc it's better for them if they prosecute and lose, instead of dismissing and/or bargain. (FYI: My offense was driving with my blinker on!) So now $25,000 in legal fees later I am going to court for trial. (By the way, I allowed to get charges dismissed w/ accelerated rehab course once in my lifetime, which, of course, is probably the smart thing to do, but it isnt the right thing to do BC I was NOT impaired. I just refuse.) I am not asking you to be a police officer or judge, but I do have one toxicology question and one med question: When I was arrested, I had not urinated for about 4 hours and I had to go bad. The officer would not let me until I gave my urine specimen, which I did. Later, I was told that proper protocol is to let someone void bladder once BEFORE a urinalysis. That wasn't done. I believe it would have made a difference. QUESTION: 1) is that right? and 2) I have read that lab results at levels so low as mine were are completely unreliable. Agree? I have gone through the details provided in query and understand your concerns.

I am sorry to inform you that the defence is not strong and this is right to ask someone to not void bladder before urinalysis. Even if they have allowed you to void probably results will not be different from current one. Low concentration in urine compare to blood level is not surprising and it often occurs in this way. High BC is infocative that there was alcohol in body.

Regarding your second question I do agree that there are false positive results and chances are much more at threshold concentration level.
