Question: In CA where you can purchase medicinal and recreational marijuana, does CPS take your baby if you and newborn test positive at delivery?

So, it would seem very unlikely.
The laws seem to say there is high discretion on the part of the doctor.

Testing is all over the map. There should be a requirement of consent for ALL urine testing--that's a general standard. BUT it's been not very enforced.

If the doctor suspects there COULD be a hazardous situation, then the doctor is REQUIRED to make a report. It is a very grey area in California in 2020 whether the not consented to urine positive for ONLY cannabis is enough to get someone to make a report to CPS.
It's a maybe.
