Question: can a permanant lumbar nerve block be used after l5-s1 fusion failed and pain worse to point of not being able to sit or stand?

Permanent nerve block, or nerve ablation, can be done in small nerves that doesn't carry any indispensable function, in case of low lumbar nerves ( in your case L5, or S1 nerve root ) can lead to significant disability, because these nerves supply important muscles of the leg.

In my opinion, other possible treatments for nerve pain after unsuccessful fusion, should be exhausted first.

These include temporary nerve blocks, epidural injections, reconsider surgery and widened fusion, TENS, etc.
